Rodney Gomez

Rodney Gomez is a Partner and Head of both the Infrastructure & Projects and Engineering & Construction practice groups at Shearn Delamore & Co., with 30 years of experience in arbitration, adjudication, mediation and litigation involving construction contracts, consultancy agreements, engineering contracts, infrastructure projects, procurement contracts, and project management.

He appears frequently as an Arbitrator in construction and engineering disputes, and as Counsel in all levels of the Malaysian Courts. He has also appeared in international arbitration proceedings, international adjudication proceedings and mediation proceedings. Since the introduction of the Construction Industry Payment and Adjudication Act 2012, he has acted as Adjudicator and as Counsel in adjudication proceedings. Notable matters include acting as Counsel for the MRT2 Project (a Federal Government public interest works project), successfully defending against a claim in the region of RM80 million; acting as lead Counsel for Yuk Tung Construction Sdn Bhd in a dispute involving claims of RM105 million; and leading a team that represented the Government of India in applications to set aside arbitration awards amounting to USD200 million. He also regularly advises clients on project implementation of building and engineering contracts in areas such as light rail transport, biodiesel plants, power plant facilities and residential housing.

Rodney holds an LL.B (Hons) from the University of West London and is a Barrister-at-Law of the Middle Temple. He was admitted as an Advocate & Solicitor of the High Court of Malaya in 1990 and is also admitted in England & Wales.

He is a Fellow of the Chartered Institute of Arbitrators (FCIArb), the Malaysian Institute of Arbitrators (FMIArb) and the Malaysian Society of Adjudicators (FMSAdj), and serves on the Panel of Arbitrators and Adjudicators at the Asian International Arbitration Centre (AIAC).
